It is allowed only for heterosexual officially married couples unable to achieve pregnancy naturally.
The Intended Parents are protected by the legislation: if a couple is officially married and if one of a couple is genetically related to a baby the couple is considered to be the biological parents. According to Ukrainian legislation, a surrogate mother can’t claim any rights as to the baby, and only you as a mother and a father will be indicated in the child’s birth certificate.
❓Where do surrogate mothers undergo screenings and where do they give birth?
Surrogate mothers undergo screenings and check-ups at Biotexcom during the whole pregnancy. Once they reach 30-34 weeks of pregnancy, surrogates have to arrive in Kyiv for further surveillance. They are giving birth in our partner maternity hospitals in the capital of Ukraine.
❓Who will be registered as the child’s parents? Will the surrogate be indicated in the birth certificate?
Once you pass the DNA test and it states your genetic link with a baby, you will be registered as official parents. A surrogate mother isn’t indicated in the birth certificate.
❓How long will the surrogacy process take?
The answer depends on the type of package (its waiting time of matching a couple with a SM) and the number of attempts needed. 1 attempt usually takes 1 month of stimulation, 9 months of pregnancy, and 1-2 weeks of completing the paperwork. Add the waiting time (12-4 months) and this will be an approximate answer.
❓What’s the success rate for surrogacy?
The success rate may vary depending on the quality of eggs used. If the donor eggs are used, success rate may reach up to 80%. Anyway, majority of Biotexcom packages are unlimited, so a baby is guaranteed.

Myth 1: Surrogacy is child trafficking
This is false. Infertile couples choose surrogacy because the child is biologically theirs through IVF using the parents’ genetic material. The surrogate mother has no genetic connection. If genetics were irrelevant, couples would choose adoption instead.
Myth 2: Surrogacy is illegal in Ukraine
Surrogacy is fully legal in Ukraine and regulated by law, which is why the country is popular among infertile couples.
Myth 3: Finding a surrogate independently is cheaper
Independent searches often involve fraud and serious risks. A surrogacy center provides medical, legal, and psychological support, supervises the pregnancy, and handles all documentation, reducing potential problems.
Myth 4: A surrogate mother can keep the child
Under Ukrainian law, parental rights belong only to the biological parents. The surrogate has no legal right to the child and is contractually obligated to transfer the baby after birth.
Myth 5: Parents may refuse the child
Such cases are extremely rare. Couples enter surrogacy after years of waiting and sign a contract obligating them to accept the child in all circumstances.
